"Copyright is a form of protection grounded in the U.S. Constitution and granted by law for original works of authorship fixed in a tangible medium of expression. Copyright covers both published and unpublished works. " as stated at http://www.copyright.gov. Examples of copyright are when someone uses someone Else's photo as their profile picture without their consent, like on Facebook. An other example is when someone copies another persons literature and sells it as is own.

In my words Fair Use is a person uses copyright material and samples it or makes a parody out of it or even criticizes it. An example of being protected by Fair Use is when the film maker of Muhammad Ali used a small portion of one of his matches in his film. That portion of the film was informational.

Shepard Fairey made the Obama "Hope" picture. He was arrested and had two years of probation. The court  saw it as a criminal attempt for making  and destroying files and coaching a witness while embroiled in a copyright infringement argument over the issue of the use of a famous image by the Associated Press that features Barack Obama.
